28 USC§1331- sovereign immunity Act
Let petitioner cite from this Act, “In 1795, the Eleventh Amendment was ratified in response to this ruling, removing federal judicial jurisdiction from lawsuits prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State". Therefore, the sovereign immunity of the USA is not valued in the Vietnamese American prisoner of war trial when the USA has deprived its ally, Vietnam. As 28 USC §1346, the US, as defendant, therefore, cannot be protected by sovereign immunity.
